FODMAP Scanner: IBS Diet is a mobile application designed to help users identify and track FODMAP levels in food products using AI-powered image analysis technology. The App provides:

• AI-based FODMAP content analysis from product images
• Barcode scanning with multi-tier product lookup (local database, Open Food Facts, and USDA FoodData Central)
• Personal product list management with unlimited lists (Premium)
• Low FODMAP recipe browsing and discovery (powered by Spoonacular API)
• Symptom tracking and insights dashboard
• Dietary preference management
• Product categorisation and organisation tools
• PDF export functionality for sharing product lists

4. User Accounts

4.1 Account Creation

• You can create an account using Email, Apple Sign-In, or Google Sign-In
• When using Apple Sign-In or Google Sign-In, you agree to be bound by their respective terms of service and privacy policies
• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities under your account
• You must be at least 13 years old to create an account

4.2 Account Security

• Notify us immediately of any unauthorised access or security breach
• We are not liable for losses caused by unauthorised use of your account

5. Acceptable Use Policy

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorised access to our systems
• Upload malicious code, viruses, or harmful content
• Reverse engineer, decompile, or disassemble the App
• Use the App to harass, abuse, or harm others
• Impersonate any person or entity
• Collect or harvest user data without permission
• Interfere with the App's operation or security
• Use automated systems or bots to access the App

6. Intellectual Property Rights

6.1 Our Rights

The App and all its contents, features, and functionality (including design, text, graphics, logos, icons, images, audio clips, and software) are owned by RM Digital Enterprise LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Rights

You retain all rights to the content you upload to the App (including photos and product information). By using the App, you grant us a limited licence to:

• Process and analyse your images using AI technology
• Store your data as necessary to provide the service
• Use aggregated, anonymised data to improve our services

6.3 Trademarks

"FODMAP Scanner: IBS Diet" and related logos are trademarks of RM Digital Enterprise LLC. You may not use these trademarks without our prior written permission.

7. AI Analysis and Accuracy

• The App uses artificial intelligence technology (Google Gemini AI) to analyse food products
• AI analysis may not always be accurate or complete
• Results depend on image quality, product labelling, and database information
• We do not guarantee the accuracy, reliability, or completeness of any analysis
• Barcode data is sourced from our local database, Open Food Facts, and USDA FoodData Central. Data from these sources may be incomplete or outdated
• Recipe data comes from Spoonacular API and is filtered for Low FODMAP content. Spoonacular's filtering may not be 100% dietitian-verified
• You should verify results with other reliable sources
• We are not responsible for any consequences resulting from reliance on AI analysis or third-party data

8. User Content and Conduct

• You are responsible for the content you upload to the App
• Do not upload illegal, offensive, or inappropriate content
• Do not upload content that infringes on others' intellectual property rights
• We reserve the right to remove any content that violates these Terms

9. Service Availability

• We strive to provide reliable service but do not guarantee uninterrupted access
• The App may be temporarily unavailable for maintenance or updates
• We reserve the right to modify, suspend, or discontinue the App at any time
• We are not liable for any service interruptions or data loss

10. Subscription and Payments

• The App offers both free and premium subscription tiers
• Free tier includes 3 analyses per day
• Premium subscriptions are available as monthly ($3.99/month) or annual ($29.99/year) plans
• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
• You can manage or cancel subscriptions through your App Store account settings
• Refunds are handled according to App Store policies
• Prices may vary by region and are subject to change with 30 days notice

You agree to indemnify, defend, and hold harmless RM Digital Enterprise LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your content uploaded to the App

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

14. Termination

14.1 By You

You may terminate your account at any time by deleting the App and contacting us to request account deletion.

14.2 By Us

We may terminate or suspend your account immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Pose a security risk to the App or other users
• Upon termination, your right to use the App ceases immediately

15. Third-Party Services and Links

The App may contain links to third-party websites or services not owned or controlled by us. We:

• Are not responsible for third-party content or practices
• Do not endorse third-party services
• Recommend reviewing third-party terms and privacy policies

15.1 Recipe Attribution

• Recipe data is provided by Spoonacular API and subject to their Terms of Service
• Recipes displayed in the App include links to original recipe sources
• When you click "View Original Recipe," you will be directed to external websites not controlled by us
• We are not responsible for the accuracy, content, or availability of external recipe websites
• All recipe credit and intellectual property belongs to the original recipe creators

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of the United States.

17. Dispute Resolution

17.1 Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally by sending a written notice to support@fodmapscanner.app.

17.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except for disputes that may be brought in small claims court.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Sending in-app notifications for material changes

Your continued use after changes constitutes acceptance of the modified Terms.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RM Digital Enterprise LLC regarding the use of the App.
